With the rise in prices for retro games and retro consoles — seriously, just look at how much GameCube games used to cost then versus now — more and more gamers are turning to emulation as a means to experience gaming’s past. That, or waiting for various developers to re-release their older titles via collections, like the upcoming Mortal Kombat: Legacy Kollection.
However, it appears that even emulating games has its own risks. Just ask Italian YouTuber Once Were Nerd, who is facing a litany of legal charges, including the potential for jail time — all over creating videos with emulated devices.
Be Careful With What You Showcase On YouTube, Or Else You’ll Face The Consequences
As first reported by Android Authoirty, Once Were Nerd, who covers retro gaming in-depth on YouTube, is facing legal repercussions not from the discussions they have, but rather the devices they’re using.
Specifically, the YouTuber states that authorities from the Guardia di Finanza showed up at his house with a search warrant related to promoting pirated materials. There, they seized a variety of handheld emulation devices.
Those emulation devices are seemingly the subject of his legal troubles, as they often ship with data cards filled with ROMs of copyrighted games. According to Android Authority, the ownership is subject to charges under Article 171 of the Italian Copyright Law. The punishment for violations includes fines and three years of jail time.
In the interim, a GoFundMe has been set up to cover the YouTuber’s legal expenses. There, he believes that his case will head to trial and has already begun the process of obtaining counsel, according to a separate translation via PC Gamer.
At the moment, it’s unclear when a potential trial will start. So far, the creator’s YouTube page is still up, and he has hit nearly 90 percent of his GoFundMe goal.
